EDUCATION LAW NOTES: The Latest on Masks in Connecticut Schools: The Legislature Begins to Act – February 12, 2022
Last night, the Connecticut House of Representatives passed (as amended) House Bill 5047 (“An Act Concerning The Extension Of Certain Executive Orders And Department Of Public Health Authority”). The bill awaits a vote in the Senate that is scheduled for Monday, February 14, 2022.  Parenthetically, those provisions providing for “COVID relief days” and shortening the school year were removed from the bill that passed. In the absence of any action, the Executive Orders would expire on February 15, 2022.  

EDUCATION LAW NOTES: Decision Time: What Does the End of Statewide Mask and Vaccination Mandates Really Mean for Connecticut Schools? – February 8, 2022
While on February 15, 2022, the Governor’s emergency powers that led to these mandates will expire,  it now appears based on comments from the Governor yesterday that  Governor Lamont 1) will not be renewing the statewide school employee vaccination mandate, and 2) will be delegating the decision on the statewide school masking mandate to the Connecticut Department of Education (SDE) and Public Health (DPH), with these departments currently planning on lifting the statewide mandate on February 28, 2022.  We will follow this breaking story as more information becomes available, but in the meantime, here is my take on the state of play as schools suddenly acquire control over these hot button issues.  In short, Connecticut schools soon will have considerable discretion to make the decisions that they deem appropriate on behalf of their students, staff and broader school communities. 

WORKING TOGETHER BLOG: Red Light, Green Light: A Status Update on Federal Vaccine Mandates for Private Employers – February 2, 2022
On November 5, 2021, the Occupational Safety and Health Administration (OSHA) issued an Emergency Temporary Standard (ETS) requiring most employers with 100 or more employees to either require employees to be fully vaccinated or provide proof of a negative COVID-19 test result on a weekly basis. 

CT HEALTH LAW BLOG: Connecticut Health Care Vaccine Mandates – Federal and State Update – January 28, 2022
January 27, 2022 marks the deadline for Connecticut health facilities to have policies and procedures in place to satisfy federal Center for Medicare and Medicaid Services (CMS) regulations mandating vaccines of their non-exempted staff.  In addition, the regulations require that 100% of facility staff must have received at least one vaccine dose, have a pending exemption or otherwise must be identified as needing a delay in vaccination. The regulations issued last year as an Interim Final Rule were the subject of a January 13 United States Supreme Court decision staying an injunction that had delayed implementation of the regulations in 24 states, but not Connecticut.

EDUCATION LAW NOTES: Court Upholds Law Ending the Religious Exemption to Immunizations for Students in Connecticut Schools –January 14, 2022
Connecticut law has required public and private schools to condition a student’s entry into school upon providing proof of immunizations against certain communicable diseases (including but not limited to diphtheria, pertussis, tetanus, measles, mumps, rubella, and polio).  In addition to a medical exemption, that statute previously provided an exception for where the child presents a statement from a parent or guardian that such immunizations would be contrary to the child’s (or the parent’s or guardian’s) religious beliefs.

On Monday evening (12/27/21) the Centers for Disease Control and Prevention (CDC) significantly modified its guidance for isolation and quarantine by people with COVID-19. On November 4, 2021, the Occupational Safety and Health Administration (OSHA) released its much-anticipated Emergency Temporary Standard (ETS) addressing COVID-19 vaccination policies for employers with 100 or more employees.  My colleague Zach Zeid blogged about it here.  The ETS – published in the Federal Register on November 5 and slated to take effect December 4 – requires that covered employers implement policies mandating that employees either be vaccinated or be tested at least weekly for the virus. However, there have been a number of interesting (and significant) developments in the few weeks since the rule was released.

On October 25, 2021, the Equal Employment Opportunity Commission (EEOC) issued long-awaited technical assistance concerning employees’ religious objections to vaccine requirements in the workplace. (The new guidance is Section L of the EEOC’s Q&A document entitled “What You Should Know About COVID-19 and the ADA, the Rehabilitation Act, and Other EEO Laws,” which can be found here.)  Though several state governments, and the federal government, have already issued COVID-19 vaccine mandates for employers, the EEOC’s guidance is quite timely as employers continue to face the often-thorny process of assessing religious accommodation requests from their employees.

WORKING TOGETHER: A Critical Warning to Federal Contractors and Subcontractors with Unvaccinated Employees: Time is Running Out to Comply with President Biden’s Vaccination Mandate – October 22, 2021
On September 9, 2021, President Biden issued Presidential Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors (the EO). In the EO, the President requires that certain contracts with the federal government include a clause that the contractor and any subcontractors (at any tier) comply with all guidance published by the Safer Federal Workforce Task Force for the duration of the contract.

In 2018, we published an article on Walgreens’ use of session replay scripts and how such use could lead to an accidental data breach under HIPAA. Last week, an article in Vox explained how Walgreens was again apparently leaking HIPAA protected-health information on its website through its COVID-19 testing registration system.  The story serves as a good reminder that covered entities that use their websites to collect or post patient information need to be especially careful about how their websites are structured and the analytics tools that are used on them.

EDUCATION LAW NOTES: The COVID-19 Vaccine Mandate for Connecticut School Employees – The Latest “Implementation” Guidance – September 20, 2021
On September 10, 2021, Governor Lamont issued Executive Order 13G, which set forth a revised COVID-19 vaccination mandate for Connecticut school employees (and childcare facilities). As my colleague, Melinda Kaufmann noted, the revised mandate requires all school employees hired on or after September 27, 2021 to either be 1) fully vaccinated, 2) in the process of being fully vaccinated, or 3) exempt from the vaccination requirement either because the vaccine is likely to be detrimental to the individual’s health or due to a sincerely held religious belief (and he/she is able to perform the essential functions of his/her job with a reasonable accommodation that is not an undue burden to the employer). 

EDUCATION LAW NOTES: Governor Lamont Issues Executive Order 13G Giving Further Directives Regarding Mandatory Vaccination for School Employees – September 13, 2021
As we have discussed previously, Governor Lamont’s original Executive Order 13D mandating COVID-19 vaccination for most school employees raised numerous questions.  In what appears to be an attempt to address the many concerns raised by schools, late Friday afternoon Governor Lamont issued Executive Order 13G repealing EO 13D and making some significant changes to the COVID-19 vaccination requirements for school employees (which includes private and public pre-K through 12 schools) and contractors who work in those schools.  EO 13G also applies to child care facilities (including youth camps). 

WORKING TOGETHER: Ready or Not: What Employers Need to Know About the Biden Administration’s Upcoming Vaccination and Testing Requirements – September 10, 2021
Earlier this week, the Biden Administration announced plans to implement sweeping new federal COVID-19 vaccination and testing requirements which will affect a wide-ranging number of employers and more than 100 million people. These mandates will be executed through various agencies as part of the administration’s COVID-19 Action Plan aimed to address the rapidly-spreading Delta variant.

On Wednesday, August 25, 2021, the Connecticut State Department of Education (SDE) issued “Frequently Asked Questions Regarding Vaccinations for Covered Workers in Schools.”  This guidance from the SDE addresses Governor Ned Lamont’s August 19, 2021 Executive Order 13D, which appeared to be straightforward in requiring that by September 27, 2021, all Connecticut school staff must be vaccinated (subject to disability and religious exemptions), and if not vaccinated, such staff must submit to (and provide proof of) weekly COVID-19 testing. 

EDUCATION LAW NOTES: Governor Lamont Orders Mandatory COVID-19 Vaccinations For Most School Employees and Contractors – August 24, 2021
In the next installment of what appears to be the ever-moving target of mandatory vaccinations for Connecticut school employees, the Governor issued Executive Order 13D (the “Order”) delineating the state’s requirements for the vaccinations of school staff and contractors.  The FDA also has finally issued a full approval of the Pfizer COVID-19 vaccination for those age 16 and older.  So, with school starting just around the corner, what are the current requirements for mandatory vaccinations of school employees?

On August 19, 2021, the Connecticut State Department of Education (SDE) issued its much awaited “Adapt Advance Achieve” guidance on COVID-19 mitigation strategies for Connecticut’s schools for the fall of 2021. This year’s “Adapt Advance Achieve” guidance is not as rigid as its 2020-2021 predecessor.

EDUCATION LAW NOTES: So, What About Masks in Connecticut’s Schools? The Latest (and My Best Surmises) – August 12, 2021
Last week, my law partner, Zachary D. Schurin, wrote about Governor Lamont latest/revised Executive Order – Executive Order #13A –  concerning the wearing of masks (and/or other cloth facial coverings).  While Executive Order #13A maintains the prior general indoor mask mandate for only the unvaccinated (at least until the Order expires on September 30, 2021), it empowers local governmental bodies to issue their own universal mask mandates in their facilities (regardless of vaccination status).  It appears that several municipalities have accepted this invitation to impose such mandates.

WORKING TOGETHER: Breaking . . . Governor Lamont’s New Executive Order # 13A Permits Municipal Leaders to Issue Emergency Orders Requiring Masking in Indoor Settings Regardless of Vaccination Status – August 6, 2021
On August 5, 2021, Connecticut Governor Ned Lamont issued a new executive order – Executive Order # 13A – expressly permitting chief executive officers of Connecticut municipalities to issue local emergency orders requiring masking by all persons, regardless of their COVID-19 vaccination status, in all indoor public settings within the municipality.  The new executive order was issued by Governor Lamont in response to July 27, 2021 federal Centers for Disease Control guidance on the emergence of the COVID-19 Delta variant.  The guidance recommended that all people, regardless of vaccination status, wear masks in indoor public settings in areas of substantial or high COVID-19 transmission, based on research suggesting that vaccinated and unvaccinated individuals alike can transmit the highly contagious Delta variant.

EDUCATION LAW NOTES: Federal Court Upholds Indiana University’s Mandatory Student Vaccination Policy – July 26, 2021
As COVID-19 continues to spread throughout the United States, many colleges have turned to mandatory student vaccination requirements in an attempt to return to in-person learning.  Predictably, following directly behind those mandatory policies are the lawsuits filed by students claiming that these policies violate their rights.  In what is believed to be the first federal court decision on the matter, the Federal District Court of Indiana denied the request by several students to enjoin Indiana University from implementing its mandatory vaccination policy.

In what is believed to be the first court decision on the issue of mandatory COVID-19 vaccinations, the U.S. District Court for Southern Texas upheld a hospital’s policy requiring that all of its employees must be vaccinated in order to remain employed.

Last week, in our sister blog, Education Law Notes, we addressed the ability of an employer to mandate the COVID-19 vaccine for its staff.  As discussed in that post, we were awaiting updated federal guidance that would specifically address the COVID-19 vaccine. BUSINESS LAW ALERT: What’s New this Week with PPP Loans? Deadline for Eligible Borrowers is March 31, 2021 – January 25, 2021
The Consolidated Appropriations Act, 2021 (H.R. 133) added $900 billion in stimulus relief to the spending packages dedicated to fighting the economic woes wrought by the COVID-19 pandemic. Title III of Division M of the Appropriations Act, the “Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act” (Pub. L 116-260) (the Economic Aid Act), became law on December 27, 2020, adding $284.45 billion in forgivable loans to the Paycheck Protection Program (the PPP), a loan program that is a temporary addition to the Section 7(a) loan program offered by the U.S. Small Business Administration (SBA). 

BANKRUPTCY ALERT: New Bankruptcy Relief Provisions Brought to You by the 2021 Federal Appropriations Act – December 31.2020
The new Consolidated Appropriations Act, 2021 (the “Act”), which was signed into law on December 27, 2020 (H.R. 133), includes within its 5,593 pages a number of new bankruptcy relief provisions for businesses as part of what the legislation calls the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act. 

TAX ALERT: Are Eligible PPP Expenses Deductible? IRS vs. Congress? – December 7, 2020
On November 20, 2020, the Senate Finance Committee disagreed with the IRS’s decision to treat the loan proceeds as taxable income when it released Revenue Ruling 2020-27 and Revenue Procedure 2020-51 on November 18.  Learn more here.

Governor Ned Lamont recently announced the creation of the $50 million Connecticut CARES Small Business Grant Program (the “CT Cares Grant Program”) to assist eligible small businesses and non-profits recover from the ongoing economic difficulties resulting from the COVID-19 pandemic. 

BUSINESS LAW ALERT: SBA Issues Guidance on Change of Ownership Transactions and PPP Loans – October 15, 2020 
On October 2 the U.S Small Business Association (“SBA”) issued a Procedural Notice outlining the requirements for the closing of change of ownership transactions for those borrowers who have loans under the Paycheck Protection Program (PPP).

BUSINESS LAW ALERT: SBA and Treasury Provide Relief to Small Borrowers – October 12, 2020
On October 8, 2020, the US Small Business Administration issued another Interim Final Rule under the CARES Act, providing immediate relief in the form of a simpler loan forgiveness application that is available to qualifying borrowers of PPP loans of $50,000 or less.

BUSINESS LAW ALERT: PPP Loan Forgiveness Not Taxable – October 2, 2020
Under general income tax principles, when a borrower has its indebtedness forgiven, the borrower recognizes income in the forgiven amount.  Under the CARES Act, however, Congress made clear that forgiveness of a Paycheck Protection Program loan would not give rise to cancellation of indebtedness income.

On September 8, 2020, Governor Lamont issued Executive Order 9A, which extends to November 9, 2020 all executive orders, agency orders and municipal orders issued in connection with the current states of emergency related to COVID-19.

ALERT: Governor Lamont Declares Continuing State of Emergency, Extends Executive Emergency Powers Through February 9, 2021 – September 4, 2020
Effective September 4, 2020, Governor Lamont extended the duration of the Connecticut public health and civil preparedness emergencies first declared on March 10, 2020, which had been set to expire on September 9, 2020 until February 9, 2021.

BUSINESS LAW ALERT: Federal Reserve Board Expands Main Street Lending Program to Provide Loans for Nonprofit Organizations – July 21, 2020
On July 17, 2020, the U.S. Federal Reserve Board expanded the Main Street Lending Program to provide access to loans for eligible nonprofit organizations.  Previously, nonprofit organizations were not eligible to participate in the Main Street Lending Program.

Governor Lamont’s Executive Order 7NN, modifies Section 33-1061 of the Revised Connecticut Nonstock Act to allow the corporation’s board of directors to authorize remote meetings of members regardless of whether they are authorized in the corporation’s governing documents and further suspends any inconsistent provision of the corporation’s governing documents.

BANKRUPTCY ALERT: Bankruptcy Court Overrides SBA’s Prohibition Against Extending PPP Loans to Companies in Bankruptcy – April 27, 2020
Since the CARES Act was passed into law, the SBA has required participating lenders to use an SBA-created loan application that would disqualify any small business in bankruptcy from receiving a PPP Loan.  Nothing in the CARES Act itself, however, prohibits debtors in bankruptcy from receiving PPP Loans.

The CARES Act, which, notably, provides for coronavirus aid and economic security provisions, has also expanded the deduction for charitable contributions for both individuals and corporate taxpayers under specific circumstances.

CT HEALTH LAW BLOG: Connecticut Health Care Vaccine Mandates – Federal and State Update – January 28, 2022
January 27, 2022 marks the deadline for Connecticut health facilities to have policies and procedures in place to satisfy federal Center for Medicare and Medicaid Services (CMS) regulations mandating vaccines of their non-exempted staff.  In addition, the regulations require that 100% of facility staff must have received at least one vaccine dose, have a pending exemption or otherwise must be identified as needing a delay in vaccination. The regulations issued last year as an Interim Final Rule were the subject of a January 13 United States Supreme Court decision staying an injunction that had delayed implementation of the regulations in 24 states, but not Connecticut.

In an effort to ensure that Connecticut continues taking the most equitable and efficient approach to quickly administering the COVID-19 vaccine to as many people as possible, Governor Ned Lamont announced on February 21, 2021 that the state will continue with an age-based approach to expanding eligibility to the vaccine, explaining that other previously considered scenarios proved overly complex and confusing, would potentially exacerbate inequities in vaccine distribution, and slow down the process of providing it to Connecticut residents. Educators and childcare providers will be eligible to receive the vaccine in March at dedicated clinics that will be set up specifically for those sectors.

Connecticut Residents Over 65 Can Register for COVID-19 Vaccination Appointments Starting February 11, 2021– February 9, 2021
Connecticut residents over the age of 65 will be eligible to schedule COVID-19 vaccination appointments starting on Thursday, February 11, 2021, as the state rolls into the next part of phase 1b of its vaccination program. Vaccinations for individuals over the age of 75 and those within phase 1a will continue.

The revision came in response to an August 3, 2020 decision of the U.S. District Court for the Southern District of New York, which held that the DOL’s original regulation defining “health care provider” was so expansive that it was inconsistent with the statute.

HEALTH CARE ALERT: Southern District of New York’s Decision to Invalidate Health Care Provider Exclusion and Work Availability Requirement of FFCRA May Have Implications for Connecticut – August 7, 2020
A federal judge for the U.S. District Court for the Southern District of New York vacated several key aspects of the Families First Coronavirus Relief Act, including the regulatory definition of a “health care provider” which the court found to be overbroad.  The decision leaves open to question – at least in New York – the extent to which health care employers can exclude their employees from the paid leave provisions of the Act.

CT HEALTH LAW BLOG: Connecticut Poised to Continue Expanded Telehealth Services Into 2021 – July 28, 2020
On July 28, 2020, the CT Senate passed House Bill No. 6001 to further extend and expand the telehealth services offered by in-network providers for fully-insured health plans in the state as well as those providing care and services to established Medicaid and HUSKY B patients under the Connecticut Medical Assistance Program.  The Senate’s approval sets the stage for Governor Lamont to sign into law the legislation that will impact Connecticut telehealth rules through March 15, 2021.

On May 14, 2020, the newly-appointed Acting Commissioner of the Connecticut Department of Public Health, issued an Order reinstating the requirement that a request for collection or analysis of a COVID-19 test must be made by a licensed physician, physician assistant, APRN, or pharmacist, as well as the requirement that the results be reported to the licensed provider who ordered the test.

HEALTH CARE ALERT: The COVID-19 Telehealth Boom Might be Here to Stay, but HIPAA Flexibility Might Not – May 19, 2020
One of the many changes brought by the COVID-19 pandemic may be the permanent expansion of telehealth, but not all video communications services were designed to provide sufficient privacy and security to facilitate the provision of health care (and HIPAA compliance).

On October 25, 2021, the Equal Employment Opportunity Commission (EEOC) issued long-awaited technical assistance concerning employees’ religious objections to vaccine requirements in the workplace. On August 5, 2021, Connecticut Governor Ned Lamont issued a new executive order – Executive Order # 13A – expressly permitting chief executive officers of Connecticut municipalities to issue local emergency orders requiring masking by all persons, regardless of their COVID-19 vaccination status, in all indoor public settings within the municipality.  The new executive order was issued by Governor Lamont in response to July 27, 2021 federal Centers for Disease Control guidance on the emergence of the COVID-19 Delta variant.  The guidance recommended that all people, regardless of vaccination status, wear masks in indoor public settings in areas of substantial or high COVID-19 transmission, based on research suggesting that vaccinated and unvaccinated individuals alike can transmit the highly contagious Delta variant.

Last week, in our sister blog, Education Law Notes, we addressed the ability of an employer to mandate the COVID-19 vaccine for its staff.  As discussed in that post, we were awaiting updated federal guidance that would specifically address the COVID-19 vaccine. On September 11, 2020, the U.S. Department of Labor (DOL) announced revised regulations significantly narrowing the definition of “health care provider” under the Families First Coronavirus Response Act (FFCRA). The revision came in response to an August 3, 2020 decision of the U.S. District Court for the Southern District of New York, which held that the DOL’s original regulation defining “health care provider” was so expansive that it was inconsistent with the statute.

On September 8, 2020, the EEOC once again updated its guidance on the Americans with Disabilities Act (“ADA”) and the Coronavirus pandemic.  EEOC Updated Guidance.  The new document, through a question and answer format, expands the EEOC’s prior guidance on how the ADA applies to the current pandemic.

WORKING TOGETHER: No Longer Taken at Face Value: Executive Order 7NNN and the New Requirement for Medical Documentation from Non-Mask Wearers (and What it Means to Connecticut's Employers) – August 17, 2020
Back on April 17, 2020, Governor Lamont issued Executive Order 7BB generally requiring persons to wear “face-coverings” (e.g., masks) in public.  The Order created an exemption to the obligation to use a mask or cloth face covering for, among others, anyone for whom doing so would “be contrary to his or her health or safety because of a medical condition”.

WORKING TOGETHER: Southern District of New York's Decision to Invalidate Health Care Provider Exclusion and Work Availability Requirement of FFCRA May Have Implications for Connecticut – August 7, 2020
In what promises to be a significant ruling, this week a federal judge for the United States District Court for the Southern District of New York vacated several key aspects of the Families First Coronavirus Relief Act (FFCRA), including the regulatory definition of a “health care provider” which the court found to be “vastly overbroad.”

The Trump-era National Labor Relations Board has struck again.  On July 21, 2020 in General Motors LLC, 14-CA-197985, 369 NLRB No. 127 (2020), the NLRB overruled longstanding precedent and rejected “setting-specific” standards for evaluating employee speech or conduct made in connection with otherwise protected concerted activities.

As highlighted in our recent Tax Alert, in Notice 2020-51 (the Notice) the Internal Revenue Service (IRS) provides an extension of the 60-day rollover period to August 31, 2020 for individuals who have already taken a required minimum distribution (RMD) in 2020. The extension applies to individuals who have taken an RMD from their employers’ retirement plan or from an individual retirement account (IRA), including RMDs taken prior to March 27, 2020, the date the Coronavirus Aid, Relief, and Economic Security Act (the “CARES Act”) became law.

In complying with OSHA’s requirements, employers should keep in mind that an illness like COVID-19 is characterized as work-related, and therefore reportable to OSHA, if an event or exposure in the work environment either caused or contributed to it or aggravated a pre-existing injury or illness.

The bill awaits a vote in the Senate that is scheduled for Monday, February 14, 2022.  Parenthetically, those provisions providing for “COVID relief days” and shortening the school year were removed from the bill that passed. In the absence of any action, the Executive Orders would expire on February 15, 2022.

While on February 15, 2022, the Governor’s emergency powers that led to these mandates will expire,  it now appears based on comments from the Governor yesterday that  Governor Lamont 1) will not be renewing the statewide school employee vaccination mandate, and 2) will be delegating the decision on the statewide school masking mandate to the Connecticut Department of Education (SDE) and Public Health (DPH), with these departments currently planning on lifting the statewide mandate on February 28, 2022.  We will follow this breaking story as more information becomes available, but in the meantime, here is my take on the state of play as schools suddenly acquire control over these hot button issues.  In short, Connecticut schools soon will have considerable discretion to make the decisions that they deem appropriate on behalf of their students, staff and broader school communities. 

EDUCATION LAW NOTES: Court Upholds Law Ending the Religious Exemption to Immunizations for Students in Connecticut Schools –January 14, 2022
Connecticut law has required public and private schools to condition a student’s entry into school upon providing proof of immunizations against certain communicable diseases (including but not limited to diphtheria, pertussis, tetanus, measles, mumps, rubella, and polio).  In addition to a medical exemption, that statute previously provided an exception for where the child presents a statement from a parent or guardian that such immunizations would be contrary to the child’s (or the parent’s or guardian’s) religious beliefs.

EDUCATION LAW NOTES: The COVID-19 Vaccine Mandate for Connecticut School Employees – The Latest “Implementation” Guidance – September 20, 2021
On September 10, 2021, Governor Lamont issued Executive Order 13G, which set forth a revised COVID-19 vaccination mandate for Connecticut school employees (and childcare facilities). As my colleague, Melinda Kaufmann noted, the revised mandate requires all school employees hired on or after September 27, 2021 to either be 1) fully vaccinated, 2) in the process of being fully vaccinated, or 3) exempt from the vaccination requirement either because the vaccine is likely to be detrimental to the individual’s health or due to a sincerely held religious belief (and he/she is able to perform the essential functions of his/her job with a reasonable accommodation that is not an undue burden to the employer). 

EDUCATION LAW NOTES: Governor Lamont Issues Executive Order 13G Giving Further Directives Regarding Mandatory Vaccination for School Employees – September 13, 2021
As we have discussed previously, Governor Lamont’s original Executive Order 13D mandating COVID-19 vaccination for most school employees raised numerous questions.  In what appears to be an attempt to address the many concerns raised by schools, late Friday afternoon Governor Lamont issued Executive Order 13G repealing EO 13D and making some significant changes to the COVID-19 vaccination requirements for school employees (which includes private and public pre-K through 12 schools) and contractors who work in those schools.  EO 13G also applies to child care facilities (including youth camps).

On Wednesday, August 25, 2021, the Connecticut State Department of Education (SDE) issued “Frequently Asked Questions Regarding Vaccinations for Covered Workers in Schools.”  This guidance from the SDE addresses Governor Ned Lamont’s August 19, 2021 Executive Order 13D, which appeared to be straightforward in requiring that by September 27, 2021, all Connecticut school staff must be vaccinated (subject to disability and religious exemptions), and if not vaccinated, such staff must submit to (and provide proof of) weekly COVID-19 testing.

In the next installment of what appears to be the ever-moving target of mandatory vaccinations for Connecticut school employees, the Governor issued Executive Order 13D (the “Order”) delineating the state’s requirements for the vaccinations of school staff and contractors.  The FDA also has finally issued a full approval of the Pfizer COVID-19 vaccination for those age 16 and older.  So, with school starting just around the corner, what are the current requirements for mandatory vaccinations of school employees?

On August 19, 2021, the Connecticut State Department of Education (SDE) issued its much awaited “Adapt Advance Achieve” guidance on COVID-19 mitigation strategies for Connecticut’s schools for the fall of 2021. This year’s “Adapt Advance Achieve” guidance is not as rigid as its 2020-2021 predecessor.

EDUCATION LAW NOTES: So, What About Masks in Connecticut’s Schools? The Latest (and My Best Surmises) – August 12, 2021
Last week, my law partner, Zachary D. Schurin, wrote about Governor Lamont latest/revised Executive Order – Executive Order #13A –  concerning the wearing of masks (and/or other cloth facial coverings).  While Executive Order #13A maintains the prior general indoor mask mandate for only the unvaccinated (at least until the Order expires on September 30, 2021), it empowers local governmental bodies to issue their own universal mask mandates in their facilities (regardless of vaccination status).  It appears that several municipalities have accepted this invitation to impose such mandates.

EDUCATION LAW NOTES: Breaking . . . Governor Lamont’s New Executive Order # 13A Permits Municipal Leaders to Issue Emergency Orders Requiring Masking in Indoor Settings Regardless of Vaccination Status – August 6, 2021
On August 5, 2021, Connecticut Governor Ned Lamont issued a new executive order – Executive Order # 13A – expressly permitting chief executive officers of Connecticut municipalities to issue local emergency orders requiring masking by all persons, regardless of their COVID-19 vaccination status, in all indoor public settings within the municipality.  The new executive order was issued by Governor Lamont in response to July 27, 2021 federal Centers for Disease Control guidance on the emergence of the COVID-19 Delta variant.  The guidance recommended that all people, regardless of vaccination status, wear masks in indoor public settings in areas of substantial or high COVID-19 transmission, based on research suggesting that vaccinated and unvaccinated individuals alike can transmit the highly contagious Delta variant.

EDUCATION LAW NOTES: Federal Court Upholds Indiana University’s Mandatory Student Vaccination Policy – July 26, 2021
As COVID-19 continues to spread throughout the United States, many colleges have turned to mandatory student vaccination requirements in an attempt to return to in-person learning.  Predictably, following directly behind those mandatory policies are the lawsuits filed by students claiming that these policies violate their rights.  In what is believed to be the first federal court decision on the matter, the Federal District Court of Indiana denied the request by several students to enjoin Indiana University from implementing its mandatory vaccination policy.

EDUCATION LAW NOTES: The End of the Religious Exemption to Immunizations for Students in Connecticut Schools? – April 29, 2021 -The religious exemption has become controversial, and efforts had been made in recent legislative sessions to curtail it.  Finally, after contentious public hearings and debate, the Connecticut General Assembly passed (and Governor Lamont signed on April 28, 2021) House Bill 6423, entitled “An Act Concerning Immunizations.” An overview.

Governor Lamont has issued a new Executive Order that requires local and regional boards of education to continue providing eligible employees with certain paid leave under the Families First Coronavirus Response Act.  (“FFCRA”).  Executive Order 10, Section 6, was issued yesterday (February 4, 2021) and is entitled “Paid Leave Requirements for Staff of Local and Regional Boards of Education.”

Last week, we addressed the ability of the schools to mandate the COVID-19 vaccine for staff and students.  As discussed in that post, we were awaiting updated federal guidance that would specifically address the COVID-19 vaccine. On December 16, 2020, the U.S. Equal Employment Opportunity Commission (EEOC) issued “technical assistance” guidance addressing several COVID-19 related issues, including an employer COVID-19 vaccine mandate.

To the shock of no one, the guidance concerning the use of in-person, “hybrid” and remote learning models in the Connecticut schools during the ongoing COVID-19 pandemic continues to evolve.  This is not completely surprising.  After all, the factors to be used by Connecticut schools in assessing the degree of in-person learning (and whether to go with a more “remote” model) cannot be static, but rather are subject to evolution in light of 1) the practical experiences of schools on the ground, and 2) the increase in knowledge about the nature of COVID-19 and its spread.

Shortly after declaring a State of Emergency with respect to the COVID-19 pandemic, and in light of the desire to avoid large in-person gatherings, Governor Lamont issued Executive Order 7B, which provides that the in-person open meeting requirements of Connecticut’s  Freedom of Information Act (“FOIA”) were suspended so as to  permit a public agency to 1) meet without in-person public access to such meetings, and 2) hold such meetings remotely by conference call, videoconference or “other technology”, provided that certain conditions were met (e.g., the public having the ability to view or listen to each meeting “in real time, by telephone, video, or other technology”).

As an attorney representing Connecticut educational institutions and employers in general, I have received numerous calls from clients with respect to how to properly respond to COVID-19 incidents. In light of these lingering issues, and some frankly non-compliant behaviors from many of our political leaders, it may be worthwhile looking globally at these many issues, specifically in the context of responding to situations where one has been in close contact with persons with COVID-19.
