Pullman Litigation Attorneys Represent CBIA and IAC in Joint Amicus Brief

Pullman & Comley Litigation and Appellate attorneys Dana Hrelic, Monte Frank and Meagan Cauda are representing the the Connecticut Business Industry Association (CBIA) and the Insurance Association of Connecticut (IAC) as amici curiae in support of the Defendants, who are opposing a challenge to the exclusivity provision of the Workers’ Compensation Act, a bar to civil actions brought by employees against employers for job related injuries. 

The case, Harold Dusto et al. v. Rogers Corporation et al., is an appeal arising from the trial court’s judgement granting the Rogers Corporation’s motion for summary judgement seeking to expand the reach and scope of the substantial certainty exception provision of the Connecticut Workers’ Compensation Act.

Attorneys Hrelic, Frank and Cauda argue that not only is the plaintiff’s argument contrary to well-stated precedent, it also contravenes the purpose of the Worker's Compensation Act, which was designed to represent a trade-off between employer and employee rights.
