It's 2020: New York Federal Court Holds That New Title IX Regulations Apply Retroactively

Karen A. Jeffers of Pullman & Comley's Colleges, Universities and Independent Schools practice and Melinda B. Kaufmann of the firm's School Law practice recently wrote an article for the CCIC on the new Title IX regulations.

The Office of Civil Rights (OCR) stated that the regulations would not apply retroactively, but then further explained that the new regulations would "not apply to schools' responses to sexual harassment that allegedly occurred prior to August 14, 2020." A New York federal court decided to ignore OCR guidance in October 2020.
