CONFERENCE: Attorney Michael McKeon Presented at 2016 CCIC Member Forum

Pullman & Comley attorney Michael P. McKeon, member of the Education Law Section of the firm's Labor, Employment Law and Employee Benefits Department, was a presenter at the 2016 Connecticut Conference of Independent Colleges' Member Forum on June 15, 2016. Mike hosted a conference breakout session titled "How Long The Arm? Legal Responsibility For Off-Campus Conduct."

The presentation explored OCR's "Dear Colleague" letter which appeared to require educational institutions to investigate complaints of off-campus, student-related sexual harassment. Some courts, however, have recently rejected this interpretation of OCR’s 2011 guidance, leaving uncertain when community-based actions translate into a sexually hostile campus environment, and the concomitant extent to which schools are obliged to respond to off-campus conduct. Mike provided an in-depth discussion on navigating the legal uncertainties, campus risk factors and best practices going forward.
