Mark Sommaruga Quoted in TechRepublic Article on Vaccination Mandates in the Workplace

Labor, Employment Law and Employee Benefits attorney Mark Sommaruga was quoted in a TechRepublic article which discusses how the new CDC guidelines for fully vaccinated people may affect office reentry planning. The rise of the Delta variant along with the CDC's recommendation for fully vaccinated people to wear a mask in public indoor settings could have an impact on employer stances on vaccination mandates, which has raised questions.

"The legal considerations for employers managing the COVID-19 pandemic and returning their employees to the workplace have largely remained constant in my view," said Mark. He points out that there have been recent court decisions which have upheld the employer's ability to mandate employee vaccinations, with certain exceptions for those with disabilities or religious observances. "I would think that at the very least, the [CDC's] recent guidance reminds employees of the need to ensure some level of precautions in the workplace against COVID-19," Mark added.
