A Win in the Connecticut Supreme Court

The Connecticut Supreme Court unanimously agreed with the position of our Energy and Regulatory attorneys that the state’s Public Utilities Regulatory Authority (PURA) lacked jurisdiction to resolve a contractual pricing dispute between our client, Kleen Energy Systems, and Connecticut Light and Power (now known as Eversource Energy). The Court thus directed judgment for Kleen Energy, reversing the trial court’s ruling that: (1) PURA had the statutory authority to determine the parties’ rights and obligations under their contract, and (2) our client had waived its right under the said contract to arbitrate the dispute.
