Pullman and Comley attorney Dan Schwartz was quoted in a January 19 Business Insurance article about the U.S. Supreme Court's agreement to hear a Connecticut reverse-discrimination case. The case concerns whether the New Haven Civil Service Board acted justly in refusing to certify the results of two fire department promotional exams because they may have been biased against African-Americans. As a result of the Board’s actions, a group of firefighters filed suit saying they would not be promoted. Mr. Schwartz anticipates that the Supreme Court may well be divided on the issue: “This is a very difficult question because there are arguments on both sides that have validity.” The decision could have a major effect on both public and private employers.
