Labor and Employment attorney Dan Schwartz was quoted in “Connecticut Case Spurs National Class Actions: AT&T Charged With Withholding Millions of Dollars in Overtime Pay,” in the Connecticut Law Tribune on January 4, 2010.
A Connecticut lawsuit against AT&T that was granted class action certification has led to two more lawsuits across the country alleging that the phone and Internet service provider and its subsidiaries withheld as much as $1 billion in overtime pay from the company's "first-level managers."
According to Dan, "the devil is in the details for these types of claims." He added that if AT&T can provide proof of the employees' supervisory or administrative responsibilities, the company can attempt to argue that it followed wage and hour rules properly.
