In an article in The New Haven Register , "City Facing More Firefighter Suits," labor and employment attorney Daniel A. Schwartz commented on new briefs filed before the Supreme Court that support the city of New Haven's argument that it was justified in tossing the results of a promotional exam for firefighters. In Ricci v. DeStefano, the Supreme Court ruled against New Haven and found in favor of a group of white firefighters who claimed they had been discriminated against because the city did not certify the promotion list.
According to Dan, the new complaints have "a tremendous hurdle to overcome" based on the Supreme Court decision, but at the same time, the claims could benefit New Haven if Ricci v. DeStefano goes before a jury for damages.
"I'm sure they'll say, 'This is exactly what we were talking about. These are the lawsuits we were trying to avoid'" by throwing the exam results out, he said.
