Social Media: Liability and Ethical Pitfalls For In House Lawyers

Social networking is now estimated to account for 25% of all U.S. activity on the Internet. Facebook has more than 900 million active users worldwide. Twitter claims to have over 190 million visitors each month. Dealing with social media use by those in a company's legal department implicates yet another set of obligations and risks: those arising under the Rules of Professional of Conduct and each state's machinery of attorney discipline. Pullman & Comley attorneys David Atkins, chair of the Professional Liability practice, and Daniel Schwartz, a member of the Labor & Employment practice addressed the ethical and employment law considerations of the social media phenomenon in an interactive seminar for in house lawyers sponsored by the Westchester Southern Connecticut Chapter of the Association of Corporate Counsel (WESFACCA).
