Defending Connecticut's Businesses in Franchise Disputes

In December 2012, our attorneys successfully defended a Second Circuit Court of Appeals appeal involving a Connecticut real estate agency, Realty Works, LLC, that had won a franchise dispute against international real estate franchisor GMAC Real Estate, LLC.   An arbitrator held that GMAC Real Estate had violated Connecticut’s Business Opportunity Investment Act through its business practices.  The case was arbitrated in Chicago and then appealed to the United States District Court in Connecticut, and ultimately to the Second Circuit in New York, which confirmed the arbitrator’s award.   The successful litigation is a lesson to all parties to arbitration agreements that courts will rarely overturn a well-founded arbitration award
